The Productivity Mega Deduction: What the Headline Doesn't Tell You

A $2 million production line acquired in June and the same line acquired three months later could receive completely different tax treatment in the same fiscal year. The measure behind that gap is still draft legislation — no bill, no CRA guidance — and clients are making capital decisions against it now.

Real-world planning question

The deduction arrives in year one. What rate will the client be at when it comes back?

An excavation contractor fully expenses an $800,000 machine when its combined corporate tax rate is roughly 10%, reducing its tax by about $80,000 and leaving the UCC of the class at nil. In year four, it trades the machine in for about $450,000 at a time when its combined corporate tax rate is roughly 27% — with the UCC of the class still at nil, the full $450,000 is brought back into income as recapture. The result illustrates the real planning question: what rate is the client deducting at today, and what rate could apply when that deduction comes back?

What we'll work through

01

What Qualifies, and What the Exclusion List Actually Excludes

  • Drafted as an exclusion list — "excluded property", Reg 1104(3.1)
  • The buildings carve-out operates at paragraph level, not class level
  • Why "Class 1 is out" is wrong, and wrong on a real number
  • Two routes into the definition, and which conditions each one triggers
  • Leasehold interests, and the reach into tenant fit-outs
02

Vehicles, and the Condition With No Known Answer

  • The two cumulative limbs of "excluded vehicle"
  • The order the automobile test has to be run in
  • A new Canadian-assembled pickup, and an answer better than the market assumed
  • "Assembled in a country other than Canada" — undefined, and evidentiary
  • The Reg 1103(2k) election, and the protection it preserves
03

Two Date Tests, and the Two Ways a File Fails

  • Acquisition and available-for-use, applied in sequence
  • A two-week gap that costs the deduction permanently, not for a year
  • Available-for-use survives the simplification — ITA 13(26) to (32)
  • The ITA 13(29) long-term project election, and why it now carries weight
  • Contemporaneous evidence, and the CRA guidance that does not exist
04

Who Can Use It, and What a Partial Claim Costs

  • Corporations, individuals and trusts — and the partnership taint
  • One individual member, and the cap that follows for the whole firm
  • The residual after a partial claim: ordinary rates, no accelerated incentive
  • The same-year bar — it is one deduction or the other
  • Loss expiry, and why claiming in full does not bank the benefit
05

Recapture, Rate Paths, and the Balances a Large Claim Moves

  • The empty class, and the terminal loss that no longer arrives
  • Carrybacks: three years — and what they reach retroactively
  • GRIP, eligible dividends already designated, and Part III.1 exposure
  • Safe income, checked before a planned inter-corporate dividend
  • Minimum tax: what does not bite, and what still can
06

Placement, Provinces, and the Answers That Are No

  • The stranded deduction: the asset in one entity, the profit in another
  • Why moving the asset is not the third option it looks like
  • The reorganisation block, and the estate freeze already in motion
  • Provincial conformity — and when a separate CCA schedule may be required
  • Draft legislation and no CRA guidance — what the file note has to say

What This Area Teaches
The Bigger Questions Behind a 100% Write-Off

One measure, one announcement date. The reasoning underneath is about unenacted law, deductions that reverse, and where a benefit actually lands.

Advising Before the Law Exists

Draft proposals carrying an effective date are not enacted law, and the 2024 capital gains proposal showed how far the profession will act on one anyway. What the file note records is the part that survives either outcome.

Deductible Is Not the Same as Worth Something

Whether something qualifies, when the deduction arrives, and what it is worth to this taxpayer are three separate questions. Rate path, entity placement and recapture can move the answer further than eligibility does.

Simplification in One Place, Complexity in Another

The draft removes the $1.5 million cap and the group-sharing arithmetic. What arrives with it is an empty class, no terminal loss, retroactive pressure on GRIP and safe income, and potentially a second provincial CCA schedule to carry.
